Welcome to BuildMart Australia. These Terms & Conditions apply to the use of our website, online enquiries, quotations, purchases, showroom sales, delivery, collection and any other dealings with BuildMart Australia.

By using our website, requesting a quote, placing an order, making a payment, collecting goods or accepting delivery, you agree to these Terms & Conditions.
1. General Information
The information on our website is provided for general product and service information only. We make reasonable efforts to keep product descriptions, images, pricing, stock availability and specifications accurate and up to date. However, errors, omissions or changes may occur.
Product images are for reference only. Actual colour, texture, finish, veining, shade, size tolerance and surface variation may differ, especially for natural stone, tiles, pavers, bricks and other building materials.
2. Product Suitability
Customers are responsible for ensuring that the products selected are suitable for their intended purpose, site conditions, design requirements, installation method and local regulations.
We recommend customers seek professional advice from a qualified builder, landscaper, tiler, engineer, designer or installer before purchasing or installing products.
Any product recommendations provided by BuildMart Australia are general in nature and based on the information provided by the customer.
3. Natural Variation and Batch Variation
Natural stone, tiles, pavers, bricks and similar building materials may have natural or manufacturing variations in colour, texture, size, thickness, tone, veining, surface finish and edge appearance.
These variations are part of the nature of the product and are not considered defects unless the product fails to meet applicable consumer guarantees or is materially different from its description, sample or agreed specification.
Customers should order sufficient quantity at the same time to reduce batch variation risk. We recommend allowing extra quantity for cutting, wastage, breakage, site layout and future repairs.
4. Quotes and Orders
All quotes are valid for the period stated on the quote. If no period is stated, the quote is valid for 7 days unless withdrawn earlier.
A quote does not guarantee stock availability unless confirmed in writing. An order is only confirmed once payment has been received and accepted by BuildMart Australia.
BuildMart Australia may decline or cancel an order where products are unavailable, pricing is incorrect, payment is not received, delivery is not possible, or there is a genuine operational reason.
5. Pricing and Payment
All prices are in Australian dollars. Prices may be shown inclusive or exclusive of GST depending on the website page, quote or invoice. The final payable amount will be confirmed before payment.
Payment must be made in full before dispatch, delivery or collection unless otherwise agreed in writing.
BuildMart Australia may update pricing at any time without prior notice. Confirmed orders will not be affected unless there is an obvious pricing error.
6. Stock Availability
Stock availability may change without notice. Some products may be subject to limited availability, supplier delays, shipment delays or batch differences.
If a product becomes unavailable after an order is placed, we will contact the customer to discuss suitable alternatives, backorder options or refund options where applicable.
7. Delivery and Collection
Delivery and collection terms are set out in our Shipping & Return Policy.
Customers must ensure that delivery details are accurate and that the delivery site is safe, accessible and suitable for unloading.
Additional delivery charges may apply for incorrect addresses, failed deliveries, restricted access, waiting time, re-delivery, crane truck requirements, forklift requirements, after-hours delivery or other site-related complications.
8. Risk and Ownership
Risk in the goods passes to the customer once the goods are collected by the customer or delivered to the nominated delivery address.
Ownership of the goods remains with BuildMart Australia until full payment has been received and cleared.
9. Inspection of Goods
Customers should inspect all goods upon collection or delivery.
Any visible damage, shortage, incorrect item or delivery issue should be reported to BuildMart Australia as soon as reasonably possible, preferably within 48 hours of delivery or collection, with photos and order details.
This reporting timeframe does not limit any rights the customer may have under the Australian Consumer Law.
10. Installation
Customers should inspect all products before installation. Once products are installed, cut, sealed, fixed, laid or otherwise used, it may be more difficult to assess claims relating to visible defects, shade variation, incorrect selection or installation-related issues.
BuildMart Australia is not responsible for loss or damage caused by incorrect installation, poor workmanship, unsuitable site preparation, incorrect sealing, misuse, abnormal use, lack of maintenance, chemical damage or failure to follow relevant installation guidelines.
11. Returns and Refunds
Returns and refunds are handled in accordance with our Shipping & Return Policy and the Australian Consumer Law.
For change-of-mind returns, approval is at BuildMart Australia’s discretion and may be subject to product condition, return timeframe, stock type, packaging, transport and restocking requirements.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.
12. Consumer Guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
If a product or service fails to meet a consumer guarantee, customers may be entitled to a repair, replacement, refund, re-supply, cancellation or compensation depending on the circumstances and the nature of the failure.
13. Limitation of Liability
To the maximum extent permitted by law, BuildMart Australia is not liable for indirect, incidental, special or consequential loss, including loss of profit, project delay, labour costs, installation costs, removal costs, business interruption or loss arising from use of our website, products or services.
This clause does not limit any liability that cannot be excluded under the Australian Consumer Law or other applicable laws.
14. Website Use
Customers must not misuse our website, interfere with its operation, attempt unauthorised access, upload harmful material or use the website for unlawful purposes.
We may update, suspend or discontinue any part of the website at any time.
15. Intellectual Property
All website content, including text, images, graphics, logos, product descriptions, layout and design, is owned by or licensed to BuildMart Australia and must not be copied, reproduced or used without written permission.
16. Third-Party Links
Our website may contain links to third-party websites. BuildMart Australia is not responsible for the content, privacy practices or accuracy of third-party websites.
17. Changes to These Terms
